Terms and Conditions

1. Scope of Application

1.1 These General Terms and Conditions (GTC) govern all business relationships between Swiss Aim Controller AG, 8052 Zurich, Switzerland (hereinafter "Swiss Aim Controller") and its customers via the websites swissaimcontroller.com.

2. Offer and Conclusion of Contract

2.1 The offer is addressed to:

• Persons aged 18 and over with full legal capacity,
• Customers with residence in Switzerland, the Principality of Liechtenstein or the European Union.

2.2 All offers are non-binding. A purchase contract is only concluded by:

• Shipping confirmation, or
• Confirmation of readiness for collection.

Swiss Aim Controller reserves the right to:

• Reject orders exceeding household quantities,
• Cancel orders despite order confirmation if goods are not available.

3. Order and Delivery

3.1 Order

Orders are possible via the website. Non-deliverable items will be cancelled. Claims for damages are excluded.

3.2 Delivery Times

Delivery times are non-binding. In the event of delivery delays of more than 14 days, the customer may withdraw from the contract after written notice. No right of withdrawal for individually configured controllers (Art. 16 lit. c Directive 2011/83/EU).

3.3 Partial Deliveries

Swiss Aim Controller is entitled to make partial deliveries. Cancellation of the entire order is excluded in this case.

3.4 Shipping Conditions

Delivery to Switzerland, Germany, Austria, Liechtenstein and the EU. Delivery to curb or mailbox. Shipping via DHL, UPS, DPD, Swiss Post or equivalent providers at Swiss Aim Controller's choice.

Transfer of risk: For EU consumers, Swiss Aim Controller bears the risk until handover to the customer (Art. 20 Directive 2011/83/EU). For customers outside the EU or in case of own shipping order, the risk passes upon handover to the carrier.

Customs & taxes: Deliveries outside the EU may incur customs, tax or duty obligations to be borne by the customer.

3.5 Collection

A collection service is offered.

3.6 Inspection Obligation

The customer is obliged to: inspect the goods immediately for correctness, completeness and damage; report transport damage within 5 calendar days at the latest; keep the original packaging until clarification.

4. Prices

4.1 The price displayed at the time of order is binding.

4.2 All prices within Switzerland and the EU include statutory VAT. Deliveries outside the EU may incur additional taxes, customs or fees to be borne by the customer.

4.3 Shipping costs and additional charges are shown separately.

4.4 Errors and misprints reserved.

5. Payment and Retention of Title

5.1 Payment Methods

Available payment methods are displayed in the shop. Swiss Aim Controller reserves the right to restrict payment methods, conduct credit checks, and offer invoice payment only with a payment term of 10 days.

5.2 Late Payment Fees

A fee of CHF 20 is charged from the second reminder. Claims may be assigned to collection agencies.

5.3 Payment Processing

Credit and debit cards are charged at the time of order. Prepayment orders are only shipped after payment is received.

5.4 Retention of Title

Goods remain the property of Swiss Aim Controller until full payment has been received.

6. Withdrawal, Returns, Exchange and Guarantee

6.1 Right of Withdrawal (EU consumers only)

EU consumers have the right to withdraw from the contract within 14 days without giving reasons (Art. 9 Directive 2011/83/EU). The period begins upon receipt of the goods. Registration in the service portal is required to exercise the right of withdrawal.

Return shipping costs: The customer bears the return shipping costs, except in the case of incorrect or defective delivery. In these cases, return shipping costs will be refunded after review. Swiss Aim Controller does not provide return labels.

Exclusion: No right of withdrawal for personalised products, in particular individually configured controllers (Art. 16 lit. c Directive 2011/83/EU).

6.2 Return and Refund Conditions

Goods may only be inspected and must be complete and in original packaging. Refunds are made via the original payment method. The 14-day period applies until registration in the service portal. After approval of the return, the tracking number must be entered in the service portal within 3 days, otherwise the return may be refused.

6.3 Value Compensation / Diminution in Value (especially Controllers)

The customer is only liable for loss in value attributable to handling that goes beyond the inspection of nature, characteristics and functionality (§ 357 para. 7 German Civil Code). For controllers, prolonged or repeated gameplay in particular is considered value-reducing use.

6.4 Exchange

Exchange requests must be reported in the service portal. Returns are sent to the Swiss Aim Controller address. The customer initially bears the shipping costs. After receipt of the tracking number, the replacement controller is shipped.

6.5 Defective Goods / Repairs

Defective products must be reported in the service portal. EU customers send goods to the Swiss Aim Controller address. The customer bears the shipping costs to the service centre (approx. EUR 10). Return shipping may incur customs charges to be borne by the customer. In case of fault, a paid cost estimate will be prepared.

6.6 Guarantee

Statutory warranty: 2 years. Guarantee covers repair or replacement. No guarantee for normal wear, mechanical damage or misuse.

7. Liability

Swiss Aim Controller is only liable in cases of intent or gross negligence. Liability for indirect damages or consequential damages is excluded to the extent permitted by law. No liability exists in particular for: delays by shipping providers or customs clearance; normal wear and tear; improper use, drops, liquid damage; self-repairs or modifications; commercial use; cosmetic damage.

8. Data Protection

The processing of personal data is carried out in accordance with Swiss Data Protection Act and GDPR (Regulation (EU) 2016/679).

Rights of data subjects pursuant to Art. 15–22 GDPR. Complaints may be lodged with the competent supervisory authority pursuant to Art. 77 GDPR. Further information in the privacy policy on the website.

9. Special Provisions for Modified / Personalised Controllers

9.1 Guarantee

2 years on paint, buttons, digital triggers/bumpers. Original sticks: 90 days. Hall Effect/TMR sticks: 2 years.

9.2 Exclusions

Mechanical damage, misuse, wear; liquids, moisture, soiling; extreme temperatures, drops, opening, modification; commercial use or improper cleaning.

9.3 Delivery Times

Pre-configured controllers: shipping within 30 days. No liability for delays by shipping providers or customs clearance.

10. Place of Jurisdiction and Final Provisions

10.1 Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the customer's country of residence remain unaffected.

10.2 Place of jurisdiction is Zurich or the customer's place of residence.

10.3 Swiss Aim Controller reserves the right to amend these GTC at any time. The version valid at the time of order applies.
